Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Flux VPN ("the Service," "App," or "we"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User" or "you") and Flux VPN regarding your use of our virtual private network service.

2. Service Description

Flux VPN provides a virtual private network (VPN) service that:

• Encrypts your internet connection using AES-256 encryption
• Routes your traffic through secure servers in various locations
• Helps protect your privacy and security online
• Masks your IP address from websites and services you visit

The Service is provided "as is" and we make no guarantees about uptime, speed, or availability of specific server locations. No account or email address is required to use the app.

3. Eligibility

To use Flux VPN, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using VPN services under applicable laws
• Not be located in a jurisdiction where VPN use is illegal

4. Subscription & Billing

4.1 Subscription Plans

Flux VPN offers various subscription options including Weekly, Monthly, and Annual plans. Current pricing is displayed within the App and on the App Store. Prices may vary by region and are subject to change.

4.2 Free Trial

New users may be eligible for a free trial on select plans. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged.

4.3 Automatic Renewal

All subscriptions automatically renew at the end of each billing period unless you cancel. You will be charged within 24 hours before the end of the current period.

4.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings:

1. Open Settings on your device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select Flux VPN
5. Tap "Cancel Subscription"

Cancellation takes effect at the end of the current billing period. You will retain access until then.

4.5 Refunds

All purchases are processed through Apple's App Store. Refund requests must be submitted directly to Apple in accordance with their refund policy. We cannot process refunds directly.

5. Acceptable Use

You may use Flux VPN for lawful purposes including:

• Protecting your privacy on public Wi-Fi networks
• Securing your internet connection
• Accessing content available in your geographic region
• Preventing third-party tracking
• General browsing and online activities

6. Prohibited Activities

You may NOT use Flux VPN to:

• Engage in any illegal activities under applicable laws
• Transmit malware, viruses, or malicious code
• Conduct hacking, unauthorized access, or cyberattacks
• Distribute child exploitation material (we actively cooperate with authorities)
• Send spam or engage in phishing activities
• Infringe on intellectual property rights
• Harass, threaten, or harm others
• Circumvent technological protection measures
• Engage in activities that could damage our infrastructure or reputation
• Resell or redistribute the Service without authorization
• Attempt to reverse engineer the application
• Abuse the Service in any way that affects other users

7. Intellectual Property

All content, features, and functionality of Flux VPN, including but not limited to the app design, logo, graphics, and software, are owned by Flux VPN and protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Complete security or privacy (no system is 100% secure)
• Accuracy of information provided
• Compatibility with all devices or networks

We do not guarantee that the Service will meet your specific requirements or expectations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUX VPN SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or failures
• Actions taken based on reliance on the Service
• Third-party actions or content

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Flux VPN, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws

11. Termination

We reserve the right to suspend or terminate your access to the Service:

• For violation of these Terms
• For engaging in prohibited activities
• At our sole discretion, with or without notice

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on our website
• Updating the "Last updated" date
• Providing notification through the App for significant changes

Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Canada.
